Appellant has twice been found guilty by a jury of first degree murder of his wife. In both instances a jury fixed his punishment at life imprisonment, and he was adjudged and sentenced accordingly by the trial court. An appeal from the first judgment and sentence resulted in a reversal by this Court. 46 Ala.App. 342,
