Alvin J. Breaux was tried and convicted in the Criminal Court of Fulton County on an accusation charging him with violating Code Ann. § 26-2610 (b) (Ga. L. 1968, pp. 1249, 1316). Prior to the trial the defendant attacked the constitutionality of this statute. The trial court held that the statute was constitutional. The jury found that the defendant was guilty and he was sentenced to 12 months imprisonment...
