ROBERTSON, Justice:

James B. Cone and Christopher Linkenhoker were jointly indicted by the Forrest County grand jury at the July, 1971, term for unlawful possession of marijuana. Cone was granted a severance. He was then tried, convicted and sentenced to serve a term of two years in the State Penitentiary and to pay a fine of $1,000.00.
