This is a direct appeal from a conviction of involuntary manslaughter. Appellant was indicted for second degree murder in the shotgun death of Betty Spiller. A jury trial commenced on March 16, 1970. Appellant was found guilty of involuntary manslaughter and was sentenced to state prison for a term of one to ten years. His motion for a new trial was overruled on June 23, 1970.
