The case is properly before the Court on a petition for writ of habeas corpus. An evidentiary hearing was held on January 16, 1973 in order to determine if the State's refusal to allow petitioner gain time was proper. Briefs were to be filed by January 23, 1973. Petitioner filed his brief; but respondent failed to do so, evidently being of the opinion that adjudication of claims...
