Defendant Woods was indicted on four counts of distribution of a controlled substance in violation of 21 U.S.C. § 841(a)(1). He was acquitted on the first count for alleged distribution of heroin on October 30, 1972, but was convicted on the other three counts which involved similar violations on subsequent dates.
