INZER, Justice:

Appellant Jimmy Scott was indicted at the November term of the Circuit Court of Washington County for the crime of murder in the killing of John Dillard. He was tried at the February 1972 term of the court and the jury found him guilty of manslaughter. He was sentenced to serve a term of fifteen years in the State Penitentiary. From this conviction and sentence he appeals. We affirm.
