This appeal comes from a judgment in the Superior Court of Fulton County, declaring the provisions of a testamentary charitable trust, contained in the will of Harriet McDaniel Marshall, not violative of Code Ann. § 113-107, and therefore valid.

Harriet McDaniel Marshall executed her will on July 11, 1962, and died September 28, 1962, 79 days after said execution. Harriet Marshall was survived...
