This appeal from a conviction for manslaughter comes before us under the provisions of G.L.c. 278, §§ 33A-33G. The defendant has assigned as error the trial judge's refusal to direct a verdict in his favor and to charge the jury in accordance with his requested instruction No. 3. Other matters assigned as error were not argued in the defendant's brief and are treated as waived. Appeals Court Rule 1:13.
