On April 28, 1971 the theatre owned by plaintiff was destroyed by fire. He made demand on his insurer, American Employers Insurance Co., hereinafter referred to as "American", to pay the sum of $6,000.00, the amount for which it insured plaintiff's theatre. Defendant refused to pay on the grounds that the policy had been cancelled prior to the fire. Plaintiff filed suit against American to recover the face value of the policy.
