Plaintiff Helmut Stein filed a suit for damages in two counts. In Count I he alleged that by reason of fraud and misrepresentation by defendant Paul Jung, he had been damaged in the sum of $12,335.18. In Count II he sought punitive damages on the ground that the false representations were maliciously made. In response, defendant Jung alleged the existence of a partnership between plaintiff and defendant; by his answer denied any fraud or misrepresentation...
