Appellant was indicted in Mobile County for violation of Title 14, § 326(2), Recompiled Code 1958, which, omitting the penalty, reads as follows:

"It shall be unlawful for any person to take or attempt to take any immoral, improper, or indecent liberties with any child of either sex under the age of sixteen years, with intent of arousing, appealing to, or gratifying the lust or passions or sexual desires...
