At the general election in November, 1972, Tommy Smith was elected sheriff of Garland County. At that same election the incumbent sheriff, Eugene "Bud" Canada, was elected to the Arkansas Senate from Garland County. On December 26, 1972, Tommy Smith died and on December 29, 1972, Mr. Canada resigned from the office of sheriff, whereupon the Governor appointed the appellee, William D.
