Defendant was convicted of the offense of statutory rape, allegedly committed on Mary Jane Seeley. Trial by jury was held before Bownes, J., who reserved and transferred defendant's exceptions. Prior to argument in this court the case was returned to the superior court for hearing on a motion for a new trial based upon newly discovered evidence and a claim that the prosecution suppressed evidence favorable to the accused.
