The defendant was charged with the crime of uttering and publishing a forged check in violation of MCLA 750.249; MSA 28.446. On April 10, 1972, the defendant pled guilty to the charge of attempted uttering and publishing. MCLA 750.92(2); MSA 28.287(2). On April 24, 1972, the defendant was sentenced to a term of four to five years in prison. The defendant filed a motion to withdraw his plea of guilty and vacation of sentence on July 21, 1972.
