The defendants were indicted for an alleged violation of 17 M.R.S.A. § 951,1 the indictment charging:

"That on or about the 21st day of April, 1972, and continuously thereafter, in the City of Portland, County of Cumberland and State of Maine, the above named defendants JOSEPH FENTON and TIMOTHY JAMES did conspire and agree together to commit the crime of intent...
