MORTON, District Judge.

This is a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254 in which no issues of material fact exist.

The petitioner is presently incarcerated in the Nashville Metropolitan Jail and is charged with the offense of armed robbery. He seeks release from his confinement on the ground that his being tried for the offense with which he is charged would result in his being placed twice in jeopardy...
