The defendant, Di Bartolo, having waived trial by jury, was convicted upon his trial by the judge of possession of heroin, a violation under R.S. 40:962, as amended by Acts 1951, No. 30, § 1, and was sentenced to five years' imprisonment in Louisiana State Penitentiary.
