This appeal is from a conviction for violation of 21 U.S.C. § 841(a)(1), possession of controlled substances with intent to distribute or dispense. Appellant waived trial by jury and the case was tried before the Court with the same judge presiding who conducted the hearing on a motion to suppress evidence.
