A jury convicted Robert Knapp of murder in the first degree, C.R.S. 1963, 40-2-3, and assessed the penalty at life imprisonment. The murder occurred in the course of the robbery of a small grocery store. When the proprietor attempted to protect his store, he was shot to death by the robbers.
