Mr. Justice McEWAN delivered the opinion of the court.

The defendant was charged with the felonious crime of burglary in violation of § 6-129, W.S. 1957. The jury returned its verdict in which it found him guilty as charged. The district court entered judgment and sentence in which the defendant was sentenced to the Wyoming State Penitentiary for a term of not less than one year and not more than two years, and, in addition, pay a fine of $250, which sentence...
