Campinha was injured on September 15, 1965, when a piece of heavy construction equipment called a Gradall backed accidentally into a trench where he was working and twisted and crushed his foot. The Gradall was owned by the defendant James J. Devine, Inc. (Devine) and was operated by the defendants Anderson and Fenton. Campinha was employed by the J.F.
