This is a damage action under the Civil Rights Act. The Court has jurisdiction under 28 U.S.C. § 1343, 42 U.S.C. § 1983. The plaintiff Mr. Willard Smartt was injured while in the custody of police officers of McMinnville, Tennessee on November 18, 1970. He had been engaged with a companion Mr. Hervy Bowlin in a day-long spree of drinking beer and was arrested...
