On October 2, 1971, defendant was convicted by a jury of assault with intent to rape, MCLA 750.85; MSA 28.280, and was subsequently sentenced to a term of 9-1/2 to 10 years in prison with the recommendation that he not receive any time off for good behavior and that he not be considered for parole until such time as he had served the maximum sentence.
