REARDON, J.

The defendant was convicted on separate indictments of murder in the first degree, and of rape. On the murder indictment he was sentenced to death under the mandatory provisions of G.L.c. 265, § 2. He was sentenced to imprisonment for life on the indictment for rape. The case is here under the provisions of G.L.c. 278, §§ 33A-33G.
