On December 9, 1971, the Grand Jury of Mobile County returned an indictment charging appellant with murder in the first degree. On December 29 the trial court appointed counsel to represent and defend him and upon being arraigned, appellant interposed a not guilty plea with leave to file special pleas within thirty days.
