Appellant was convicted of murder in the first degree and sentenced to life imprisonment.

The state's evidence tended to show that at approximately 2:00 o'clock, A.M., on October 8, 1970, the appellant entered the Montgomery Truck Stop on U. S. 231 for gas and transmission fluid.
