KING v. STATE

No. S-176.

272 So.2d 170 (1973)

Henry KING, III, Appellant, v. STATE of Florida, Appellee.

District Court of Appeal of Florida, First District.

January 25, 1973.

Attorney(s) appearing for the Case

Ken Davis, Public Defender, for appellant.

Robert L. Shevin, Atty. Gen., and Donald K. Rudser, Asst. Atty. Gen., for appellee.

PER CURIAM.

This court treats this appeal in the nature of a Habeas Corpus petition for a belated appeal, said appeal having been frustrated or thwarted by a state official, to wit: The Public Defender, and having carefully considered the record and briefs, it is our considered opinion, that no error appears. The Order appealed from is therefore affirmed and the conviction and sentence affirmed.
