On February 13, 1971 Chalmer Frank Boxell and his wife pulled into a parking lot across the street from the Boxell residence at 613 Osage Street, Fort Wayne, Indiana. As they were getting out of their car, the Appellant pulled up behind them and got out of his car with a rifle.
