OPINION

PAOLINO, Justice.

This case is before us on the defendant's appeal from a judgment entered in the Superior Court ordering the defendant to convey to the plaintiff certain real estate located in Forio, Ischia, Italy.

On April 3, 1969, plaintiff commenced this civil action against defendant by filing a complaint in the Superior Court in Providence. He alleges in the complaint that he engaged defendant in March, 19661
