SIMONS, District Judge.

This matter is before the court on a Motion to Dismiss filed by defendants Bryan and Hunt.

Plaintiffs, South Carolina state prisoners who are habitual petitioners to this court, instituted this action invoking the declaratory judgment statute (28 U.S.C. § 2201) and the so-called Civil Rights Act (42 U.S.C. §§ 1983 and 1985(3)).
