BOYD, Justice.

This cause is before us on appeal from the Circuit Court, Dade County. The trial court, at trial, denied defendant's motion to dismiss, thereby passing on the validity of Sections 790.011 and 790.25,2 Florida Statutes, F.S.A., giving this Court jurisdiction of the direct appeal under Article V, Section 3(b)(1) of the Constitution of the State of Florida, F.S.A.
