This is an action to recover damages for the death of Tilford L. Byers. The action is brought by his widow, Clarice Byers, to whom we will refer as plaintiff, pursuant to the provisions of K.S.A. 60-1902. The case was tried to a jury which found in favor of the plaintiff and judgment was entered on the verdict.
