Plaintiff-appellant is seeking review of a final judgment of dismissal of his wrongful death claim.

While at his job on November 14, 1969 Carlos P. Herrero was using a drill manufactured by defendant-appellee, Black and Decker Manufacturing Company. As a result of a defect in the drill, he was electrocuted and died on the same day.
