Defendant, Albert J. Roberge, was found guilty in the Seventh District Court, Division of Northern Kennebec, of operating, on May 21, 1970, a motor vehicle in the City of Waterville while his faculties were impaired by the use of intoxicating liquor.1 In an appeal to the Superior Court (Kennebec County), which allowed defendant a trial "de novo", defendant submitted the case to be decided anew by a Superior Court Justice...
