The state appeals from an order granting an arrest of judgment after a jury verdict of guilty of manslaughter.

The appeal tests both the timeliness and the merits of the defendant's challenges that the information failed to charge a crime. We hold (1) the defendant's challenges that the information failed to charge a crime were timely, (2) the information did not charge the crime of manslaughter because the negligent homicide statute, where applicable...
