In September of 1968 the plaintiff was a tenure teacher in the employ of defendant board of education. Negotiations between the teachers and the board of education broke down, and from November 13 to December 26, the teachers, including the plaintiff, were on strike. The defendant board took the position that by striking the teachers had forfeited their rights to tenure and so notified them.
