This is an action to recover $2,000 for medical assistance provided to the defendant. Upon admission the defendant advised the hospital he was covered by Medicaid. After the treatment plaintiff sent its bill to the Department of Social Services hereinafter referred to as the Department. On January 2, 1969, the Department notified the plaintiff it disapproved payment of the hospital bill because the defendant had private hospitalization...
