Appellant, Randall B. Wallace, hereafter referred to as defendant, was tried by a jury and convicted in the District Court of Oklahoma County, Oklahoma, Case No. CRM-70-59, on November 2, 1970, for the misdemeanor offense of "being in actual physical control of an automobile while under the influence of intoxicating liquor." He was sentenced to serve ten (10) days in the county jail, and pay a fine of ten dollars ($10.00...
