Following a seven-day trial before Judge Bartels and a jury in the Eastern District of New York, appellant, Lawrence Miller, was convicted on the two substantive counts and one conspiracy count in an indictment arising from a September, 1970, Queens bank robbery. 18 U.S.C. §§ 371, 2113(a) & (b). The sentences, to run concurrently, were seven years on each of the substantive counts and five years on the conspiracy count. Appellant...
