This is an appeal from a district court judgment granting a writ of habeas corpus to Neil Okerlund and ordering the United States Army to give him an honorable discharge.

Okerlund had enlisted in the Army for a three-year term in June 1969. Following basic training, he was assigned, pursuant to his request, as a bandsman at Fort Sheridan. In July 1970, he was informed by his sergeant...
