Appellant brought suit in the United States district court at Indianapolis in November of 1971 purporting to represent all persons similarly situated in an action for damages against Kroger Company. She alleged that appellee, operator of a chain of supermarkets in Indiana, had illegally increased food prices during the "freeze period" commonly referred to as "Phase One."
