Appellant Kubeck was indicted in the District Court on one count of a fourcount indictment which charged him, along with Dennis Lukasik and William Hall, with concealing from the Department of Housing and Urban Development, a material fact in connection with an FHA mortgage-loan application, in violation of 18 U.S.C. § 1001.
