Before this court are defendant's motions for judgment notwithstanding the verdict and in the alternative, a new trial.

This is an action by a seaman, Edward Neidlinger, against the shipowner, Victory Carriers, Inc., for injuries allegedly sustained while plaintiff was employed upon defendant's vessel, the SS NORTHWESTERN VICTORY.
