This case is before the Court on the motions of the defendants to dismiss the indictment. In Count One the defendant, Jack P. Insco, is charged with the substantive offense of violating the provisions of § 612 of Title 18, United States Code which provides in pertinent part:

"Whoever willfully publishes or distributes or causes to be published or distributed...
