TURK, District Judge.

Petitioner, King Hairston, was tried and convicted of first degree murder in April of 1942 in the Circuit Court of Henry County, Virginia. He did not appeal. In 1967, petitioner filed for a writ of habeas corpus in the Circuit Court of Henry County in which he alleged the systematic exclusion of Blacks from the grand and petit juries which indicted and tried him.
