BUSSEY, Judge:

Appellant, Billy Gene Jenkins, hereinafter referred to as defendant, was charged and tried in the District Court of Caddo County for the offense of Assault and Battery With Intent to Kill, After Former Conviction of a Felony and was found guilty of Assault and Battery With a Dangerous Weapon, After Former Conviction of a Felony. His punishment was fixed at nine (9) years imprisonment, and from said judgment and sentence, a timely appeal...
