BUSSEY, Judge:

Appellant, Rex Daryl Davenport, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Oklahoma County, Case No. CRF-72-1067, for the crime of Illegal Operation of a Police Radio While in the Commission of a Crime, to-wit: Illegal Possession of Marijuana. He was sentenced to serve a term of two (2) years in the State Penitentiary and pay a fine of two thousand dollars ($2,000) in accordance...
