BRETT, Judge.
Appellant, Willis Bates, hereinafter referred to as defendant, was convicted in the District Court of Pottawatomie County, Case No. CRF 70-207, of assault and battery with a dangerous weapon after former conviction of a felony, and sentenced to a term of one to three years imprisonment.
