Defendant, Daniel Lopez, was tried and convicted of robbery and conspiracy to commit robbery, in violation of 1967 Perm.Supp., C.R.S.1963, 40-5-1 and C.R.S. 1963, 40-7-35, respectively.

At approximately 11:00 p. m. on the evening of February 19, 1970, two armed men entered Jim's Pizzeria, located at 4748 Tejon Street in Denver. One of the armed men proceeded to a table where four young men were eating dinner, and took money at gunpoint...
